In our constitution the process to expell the Justices is very complicated.
After our independence and before the constitution is implemented the Justice of Allahbad High Court
Shiv Prasad Sinha was suspended .
The then Governer General C.Rajgopalchari suspended him on the advice of Federal Court.
But after 1950 there is no such action noticed.
The first corruption charge was noticed against Bombay High Court Chief Justice S.K.Desai.
The Chief Justice of Supreme Court wrote him for a show cause notice.
He resigned from his post after being transferred to another High Court.
Then there was an alligation against Delhi High Court Chief Justice Sameet Mukherjee for
receiving bribe from a business man to give a decission in favour of him.
After an investigation by CBI Court he resigned from his post.
According to Dhara 124(4) of our constitution it requires to vote 2/3rd members of both Houses
for taking the serious action against the Justices of Supreme Court or High Court.
In order to appoint the Justices , there were so many changes made in course of time.
Long time ago the appointments were under the wills of Government.
Only the consent of Chief Justice of Supreme Court and the related High Court
were taken into consideration for that.
Those were some type of political appointments.
The appointments are always kept as secret till the time of President's signature on the letter.
In order to make the judiciary system clean, out of corruption and people oriented the
Judicial Standard and Accountibility Bill 2010 is going to be implemented soon.
Here there are provisions to suspend the Justices on whom there is a corruption charge.
Hope a clean Judiciary system will be there.
